Applies to all e-books, digital guides, downloadable PDFs, workbooks, templates, planners, and other digital educational products sold by Fine Finances University

This Digital Product Purchase Terms, Conditions, and Use Agreement ("Agreement") is entered into by and between Fine Finances University, owned and operated by Nya Gordon ("Company," "we," "us," or "our") and the individual or entity purchasing, downloading, accessing, or using any digital product from the Company ("Customer," "Purchaser," "Client," "you," or "your").
By purchasing, accessing, downloading, opening, or otherwise using any Fine Finances University digital product, you acknowledge that you have read, understood, and agreed to be legally bound by the terms of this Agreement in full.
PURPOSE OF THIS AGREEMENT
The purpose of this Agreement is to establish the terms governing the purchase, delivery, access, use, protection, and legal limitations associated with Fine Finances University digital products. NATURE OF THE PRODUCT
All Fine Finances University e-books and digital products are digital, intangible, non-tangible, downloadable, and irrevocable goods. This means that once a digital file, product link, portal access, or download opportunity has been delivered, the product cannot be physically returned in the same way as a tangible good.
By purchasing a Fine Finances University digital product, you understand and agree that:

ELIGIBILITY TO PURCHASE
By purchasing from Fine Finances University, you represent and warrant that:

Before completing your purchase, you are responsible for:

PAYMENT TERMS
All payments must be made in full before access to any digital product is granted.

If a payment is declined, reversed, disputed, flagged for fraud, or otherwise not successfully completed, the Company may withhold, suspend, or revoke access to the digital product.
You are responsible for any fees charged by your financial institution, card issuer, payment processor, or platform in connection with your purchase.
DIGITAL DELIVERY, ACCESS, AND NON-REFUNDABLE POLICY
All products offered by Fine Finances University are digital downloads only. At this time, we do not offer or ship any physical products.
Upon successful completion of your purchase, your digital product will be delivered electronically through one or more of the following methods:

Delivery is considered complete once the product or access link has been successfully sent to the email address provided at checkout or made available for download.
NON-REFUNDABLE DIGITAL DOWNLOAD POLICY
Due to the nature of digital products, all digital downloads are non-refundable.
Once access has been granted, no refunds, returns, exchanges, or cancellations will be issued under any circumstances. This policy applies regardless of:

NO REFUND, NO RETURN, NO EXCHANGE, NO CANCELLATION POLICY
Due to the digital and immediately accessible nature of e-books and downloadable products, all sales are final. No refunds, returns, exchanges, substitutions, credits, or cancellations will be provided once a purchase has been completed.

You understand and agree that because digital products are instantly consumable and reproducible, any attempt to request a refund after delivery places the Company at an unfair disadvantage and is contrary to the terms of sale.
By completing your purchase, you expressly waive any claim to a refund on the basis that the product is digital, educational, and delivered as described.
LIMITED LICENSE GRANT
Your purchase grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the digital product strictly for your own personal, individual, non-commercial use.

PROHIBITED USES
You may not, under any circumstances, do any of the following without prior written consent from the Company:

Upload the product to Google Drive, Dropbox, shared folders, team drives, course portals, learning systems, membership sites, forums, social groups, or social media

Post screenshots or substantial excerpts publicly

Resell, repackage, copy, clone, white-label, or redistribute the product
-
Translate, edit, modify, or adapt the content for resale or public use
-
Claim the content, framework, structure, or wording as your own
-
Use the content to create a competing product
-
Incorporate any substantial portion into your own training, course, coaching, workshop, presentation, workbook, planner, or e-book
-
Use the Company's branding, design, product flow, or protected intellectual concepts in a way that creates confusion or unfairly benefits you
Any use outside the limited personal-use license is strictly prohibited and constitutes a material breach of this Agreement.
INTELLECTUAL PROPERTY OWNERSHIP
All Fine Finances University digital products, including but not limited to e-books, text, wording, titles, concepts, modules, frameworks, worksheets, templates, visual presentation, design elements, graphics, branding, arrangement, and structure, are and shall remain the exclusive intellectual property of Fine Finances University and/or Nya Gordon unless otherwise stated.

Unfair competition and misappropriation laws where applicable
Nothing in this Agreement shall be interpreted as assigning, transferring, or licensing any ownership rights in the intellectual property beyond the narrow personal-use license expressly granted.
Unauthorized copying, adaptation, reproduction, distribution, public display, sale, or derivative use of any portion of the Company's content may result in legal enforcement.
COPYRIGHT ENFORCEMENT AND ANTI-PIRACY PROTECTION
The Company takes intellectual property protection seriously and actively monitors for unauthorized use and piracy.
The Company may use one or more of the following methods to protect its products:

If the Company discovers or reasonably suspects unauthorized sharing, reproduction, leakage, posting, resale, or duplication of any product, the Company may take any action it deems necessary, including but not limited to:

Cease and desist demands

DMCA takedown notices

Reporting to payment processors and platforms

Claims for monetary damages

Legal proceedings seeking injunctive relief, fees, and costs
A customer found to have engaged in piracy or unauthorized sharing may be held financially responsible for the resulting damages and enforcement expenses.
TECHNICAL REQUIREMENTS AND CUSTOMER DEVICE RESPONSIBILITY
It is your responsibility to ensure that your device, software, and internet environment are capable of receiving, downloading, opening, and viewing digital files such as PDFs.
You acknowledge and agree that the Company is not responsible for:

Lack of PDF reader software

Outdated devices or operating systems

Browser incompatibility
-
Storage limitations on your device

Network interruptions

Personal technology skill limitations

Printer issues

Inability to access third-party apps you independently choose to use with the product
The Company does not guarantee compatibility with every device, software version, or third-party platform.
CUSTOMER SUPPORT AND PRODUCT ACCESS ASSISTANCE
The Company may provide limited customer support related solely to basic delivery and access concerns. Such support may include confirmation that the product was sent, re-sending the link where appropriate, or confirming file format.
Support does not include:

One-on-one coaching

Ongoing tech support unrelated to delivery

Device setup support

Any request for help with access issues should be made within 48 hours of purchase or within another reasonable period designated by the Company. While the Company may choose to assist outside that window, it is not required to do so.

All Fine Finances University digital products are intended strictly for educational, informational, and general guidance purposes only.
Nothing contained in the e-book or any accompanying product materials shall be interpreted as:

CUSTOMER RESPONSIBILITY AND ASSUMPTION OF RISK
By purchasing and using any Fine Finances University digital product, you acknowledge that you are voluntarily assuming all risks associated with implementing, interpreting, or relying upon the educational information provided.
You accept full responsibility for:

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Fine Finances University, Nya Gordon, and all related parties from and against any and all claims, demands, actions, causes of action, liabilities, damages, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

Your unauthorized sharing or redistribution

Your violation of any law or third-party rights

Your reliance on the product in a way not intended by the Company
This indemnification obligation survives termination of this Agreement.
CHARGEBACK, DISPUTE, AND FRAUD PREVENTION POLICY
By completing your purchase, you agree not to initiate a chargeback, payment dispute, reversal, or unauthorized transaction claim without first making a good-faith effort to contact the Company regarding the issue.
You understand that the Company maintains records that may include:

Where a customer initiates a chargeback or dispute in contradiction of this Agreement, the Company reserves the right to:

TERMINATION OR REVOCATION OF ACCESS
The Company reserves the right, in its sole discretion, to revoke, suspend, or terminate access to any digital product without refund where it reasonably believes that the customer has:

Engaged in fraud, abuse, piracy, harassment, or misconduct
Termination of access does not waive the Company's right to pursue additional legal or equitable remedies.
THIRD-PARTY TOOLS, APPS, AND RESOURCES
Some digital products may reference or mention third-party tools, apps, websites, services, articles, or resources for educational context. Any such references are provided for general informational purposes only.
The Company does not control and is not responsible for:

The performance, privacy, pricing, or functionality of third-party platforms

Changes made by third-party companies

Service interruptions, outages, or discontinued features

Third-party data handling or terms of service

Results obtained by using outside tools
Your use of any third-party platform is solely between you and that provider.
PRIVACY OF CUSTOMER INFORMATION
The Company may collect and retain purchase-related information reasonably necessary to complete the transaction, deliver the product, maintain business records, prevent fraud, and enforce its rights.

TESTIMONIALS, FEEDBACK, AND CUSTOMER COMMUNICATION
If you voluntarily provide feedback, comments, reviews, testimonials, suggestions, or other communications regarding a product, you grant the Company the right to use that feedback for business and promotional purposes, provided the use complies with applicable law and the Company's stated practices.
The Company is not obligated to keep submitted ideas, improvement suggestions, or non-confidential feedback private unless expressly agreed in writing.
The Company also reserves the right to communicate with customers regarding:

PRODUCT UPDATES, REVISIONS, AND FUTURE CHANGES
Unless expressly stated otherwise at the point of sale, a purchase of a digital product entitles the customer only to the specific version delivered at the time of purchase.
The Company may revise, improve, expand, retire, rename, or discontinue products at any time. The Company is not obligated to provide future updates, revised editions, bonus materials, replacement products, or later versions unless such access was explicitly included in the original offer.
The Company may, at its discretion, provide updated versions or corrected files, but is under no obligation to do so.
FORCE MAJEURE
The Company shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond its reasonable control, including but not limited to:

NO WAIVER
Failure by the Company to enforce any provision of this Agreement shall not constitute a waiver of the Company's right to later enforce that provision or any other provision.
Any waiver must be in writing and signed by an authorized representative of the Company.
SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Any unenforceable provision shall be interpreted as closely as possible to reflect the original intent while remaining legally enforceable.
GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by, interpreted, and enforced in accordance with the laws of the State of Alabama, without regard to conflicts of law principles.
Any dispute, claim, or controversy arising out of or related to this Agreement, the purchase, the digital product, or the relationship between the parties shall be brought exclusively in the appropriate state or federal courts located in Alabama, and you consent to the personal jurisdiction and venue of those courts.
ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties with respect to the purchase and use of the digital product and supersedes all prior or contemporaneous discussions, representations, understandings, communications, or agreements relating to that subject matter.
No oral statement, informal communication, social media message, or customer assumption shall modify or override the terms of this Agreement unless expressly stated in writing by the Company.
ACCEPTANCE OF TERMS
By clicking purchase, completing checkout, downloading the file, opening the digital product, or otherwise using the product, you confirm that you:
