This Digital Product Purchase Terms, Conditions, and Use Agreement ("Agreement") is entered into by and between Fine Finances University, owned and operated by Nya Gordon ("Company," "we," "us," or "our") and the individual or entity purchasing, downloading, accessing, or using any digital product from the Company ("Customer," "Purchaser," "Client," "you," or "your").

 

By purchasing, accessing, downloading, opening, or otherwise using any Fine Finances University digital product, you acknowledge that you have read, understood, and agreed to be legally bound by the terms of this Agreement in full.

PURPOSE OF THIS AGREEMENT

The purpose of this Agreement is to establish the terms governing the purchase, delivery, access, use, protection, and legal limitations associated with Fine Finances University digital products. These terms are intended to protect both the Company and the purchaser by clearly defining the nature of the transaction, the scope of permitted use, the policies regarding refunds and disputes, and the rights retained by the Company in all intellectual property and digital content.

This Agreement applies to every digital product sold, distributed, or otherwise made available by Fine Finances University, whether purchased directly through our website, a payment platform, a digital storefront, a third-party checkout system, email delivery, or any other authorized distribution method.

NATURE OF THE PRODUCT

All Fine Finances University e-books and digital products are digital, intangible, non-tangible, downloadable, and irrevocable goods. This means that once a digital file, product link, portal access, or download opportunity has been delivered, the product cannot be physically returned in the same way as a tangible good.

 

By purchasing a Fine Finances University digital product, you understand and agree that:

• You are purchasing access to a digital educational resource.

• The product is delivered electronically, not physically.

• Once access is granted or the file is delivered, the transaction is deemed fulfilled.

• Because digital goods cannot be "returned" after access or delivery, all purchase decisions must be made carefully before checkout.

• You are responsible for reviewing the product description, intended use, compatibility, and scope of the item before completing your purchase.

 

The Company makes reasonable efforts to accurately describe each product, including the purpose, format, and general subject matter of the e-book or resource. It is your responsibility to ensure the product aligns with your needs before purchase.

ELIGIBILITY TO PURCHASE

By purchasing from Fine Finances University, you represent and warrant that:

• You are at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is higher.

• You have the legal capacity to enter into binding agreements.

• You are using accurate and truthful billing, payment, and contact information.

• You are authorized to use the payment method submitted at checkout.

• You are not purchasing on behalf of another person in a fraudulent, unauthorized, or deceptive manner.

• You are not purchasing for the purpose of copying, redistributing, exploiting, reverse engineering, or otherwise unlawfully benefiting from the Company's content.

 

If the Company determines that a purchase was made fraudulently, by an unauthorized person, or in violation of these terms, the Company reserves the right to deny access, revoke access, cancel future transactions, and pursue any available legal remedies.

PRODUCT DESCRIPTION AND CUSTOMER RESPONSIBILITY BEFORE PURCHASE

The Company strives to provide accurate product titles, descriptions, summaries, and promotional materials. However, you acknowledge that it is your responsibility to review all available product information prior to purchasing.

 

Before completing your purchase, you are responsible for:

• Reading the product title and description in full.

• Understanding that the product is digital and not physical.

• Confirming that the format provided, such as PDF, is usable on your device.

• Reviewing any disclosures regarding intended audience, educational scope, or product purpose.

• Ensuring your email address and contact information are accurate.

• Understanding that the purchase does not include individualized coaching, legal advice, financial advisory services, or one-on-one consultation unless explicitly stated.

 

A purchase may not be reversed simply because a customer later determines the content is not what they expected, they did not read the product page carefully, or they assumed features, deliverables, or services were included when they were not expressly offered.

PAYMENT TERMS

All payments must be made in full before access to any digital product is granted.

 

You agree to the following payment terms:

• Full payment is required at the time of purchase.

• No digital product will be delivered until payment has been successfully processed.

• Prices are listed in the currency displayed at checkout.

• Prices may be changed, increased, decreased, or withdrawn at any time without prior notice.

• Promotional pricing, coupon codes, launch discounts, or limited-time offers apply only during the stated promotional period and may not be applied retroactively.

• The Company reserves the right to correct pricing errors, typographical errors, listing errors, or technical errors at any time.

• If a payment is declined, reversed, disputed, flagged for fraud, or otherwise not successfully completed, the Company may withhold, suspend, or revoke access to the digital product.

 

You are responsible for any fees charged by your financial institution, card issuer, payment processor, or platform in connection with your purchase.

DIGITAL DELIVERY, ACCESS, AND NON-REFUNDABLE POLICY

All products offered by Fine Finances University are digital downloads only. At this time, we do not offer or ship any physical products.

 

Upon successful completion of your purchase, your digital product will be delivered electronically through one or more of the following methods:

• A download link displayed after checkout

• A confirmation email containing your access link

• A digital delivery platform or portal

 

Delivery is considered complete once the product or access link has been successfully sent to the email address provided at checkout or made available for download.

NON-REFUNDABLE DIGITAL DOWNLOAD POLICY

Due to the nature of digital products, all digital downloads are non-refundable.

 

Once access has been granted, no refunds, returns, exchanges, or cancellations will be issued under any circumstances. This policy applies regardless of:

• Whether the file has been downloaded

• Whether the product has been opened or used

• Customer satisfaction or dissatisfaction

• Misunderstanding of the product contents

• Accidental purchases

 

By completing your purchase, you acknowledge and agree that you are receiving immediate access to a digital product and therefore waive any right to request a refund.

ACCESS ISSUES & SUPPORT WINDOW

If you experience any issues accessing your files, you must contact support within seven (7) days of your purchase date.

 

To receive assistance, you must provide:

• The email address used at checkout

The Company will make reasonable efforts to ensure that access to your purchased product is properly delivered.

LIMITATIONS OF SUPPORT

Failure to contact support within the 7-day window may result in the Company being unable to guarantee re-delivery or assistance.

NO REFUND, NO RETURN, NO EXCHANGE, NO CANCELLATION POLICY

Due to the digital and immediately accessible nature of e-books and downloadable products, all sales are final. No refunds, returns, exchanges, substitutions, credits, or cancellations will be provided once a purchase has been completed.

 

This policy applies in all cases, including but not limited to:

• Change of mind

• Purchase by mistake

• Failure to read the description

• Dissatisfaction with style, wording, design, or presentation

• Belief that the product is too basic or too advanced

• Customer expectation mismatch

• Technical limitations on the customer's device

• Customer inability to open, locate, or use a PDF file

• Duplicate purchases made by the customer

• Customer deciding they no longer need the product

• Financial hardship or budgeting concerns after purchase

• Failure to achieve desired personal, business, or financial results

• Accidental checkout

• Failure to download the product after delivery

 

You understand and agree that because digital products are instantly consumable and reproducible, any attempt to request a refund after delivery places the Company at an unfair disadvantage and is contrary to the terms of sale.

 

By completing your purchase, you expressly waive any claim to a refund on the basis that the product is digital, educational, and delivered as described.

 

LIMITED LICENSE GRANT

Your purchase grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the digital product strictly for your own personal, individual, non-commercial use.

 

This means:

• You are permitted to download the purchased file to your personal device.

• You may view and use the product for your own learning, education, and internal personal use.

• You may print a copy for your own personal reference only, unless otherwise prohibited in the product listing.

• Your purchase does not transfer ownership of the content.

• Your purchase does not grant you the right to distribute, teach, republish, or commercialize the material.

 

The Company retains all ownership rights, title, and interest in and to the content at all times.

 

PROHIBITED USES

You may not, under any circumstances, do any of the following without prior written consent from the Company:

• Share the file with friends, family, peers, classmates, coworkers, clients, or team members

• Forward the e-book by email, text, cloud link, or direct download

• Upload the product to Google Drive, Dropbox, shared folders, team drives, course portals, learning systems, membership sites, forums, social groups, or social media

• Post screenshots or substantial excerpts publicly

• Resell, repackage, copy, clone, white-label, or redistribute the product

• Translate, edit, modify, or adapt the content for resale or public use

• Claim the content, framework, structure, or wording as your own

• Use the content to create a competing product

• Incorporate any substantial portion into your own training, course, coaching, workshop, presentation, workbook, planner, or e-book

• Use the Company's branding, design, product flow, or protected intellectual concepts in a way that creates confusion or unfairly benefits you

 

Any use outside the limited personal-use license is strictly prohibited and constitutes a material breach of this Agreement.

 

INTELLECTUAL PROPERTY OWNERSHIP

All Fine Finances University digital products, including but not limited to e-books, text, wording, titles, concepts, modules, frameworks, worksheets, templates, visual presentation, design elements, graphics, branding, arrangement, and structure, are and shall remain the exclusive intellectual property of Fine Finances University and/or Nya Gordon unless otherwise stated.

 

This content is protected by:

• United States copyright law

• Trademark law where applicable

• Common law intellectual property protections

• International copyright conventions and treaties

• Unfair competition and misappropriation laws where applicable

 

Nothing in this Agreement shall be interpreted as assigning, transferring, or licensing any ownership rights in the intellectual property beyond the narrow personal-use license expressly granted.

 

Unauthorized copying, adaptation, reproduction, distribution, public display, sale, or derivative use of any portion of the Company's content may result in legal enforcement.

 

COPYRIGHT ENFORCEMENT AND ANTI-PIRACY PROTECTION

The Company takes intellectual property protection seriously and actively monitors for unauthorized use and piracy.

 

The Company may use one or more of the following methods to protect its products:

• Download tracking

• Transaction logs

• Access history

• Watermarked copies

• Customer-specific file identifiers

• Email delivery verification

• IP address records

• Platform reporting systems

• Marketplace monitoring

• Search and scan tools for unauthorized uploads

 

If the Company discovers or reasonably suspects unauthorized sharing, reproduction, leakage, posting, resale, or duplication of any product, the Company may take any action it deems necessary, including but not limited to:

• Immediate revocation of access

• Refusal of future purchases

• Permanent customer ban

• Cease and desist demands

• DMCA takedown notices

• Reporting to payment processors and platforms

• Claims for monetary damages

• Legal proceedings seeking injunctive relief, fees, and costs

 

A customer found to have engaged in piracy or unauthorized sharing may be held financially responsible for the resulting damages and enforcement expenses.

 

TECHNICAL REQUIREMENTS AND CUSTOMER DEVICE RESPONSIBILITY

It is your responsibility to ensure that your device, software, and internet environment are capable of receiving, downloading, opening, and viewing digital files such as PDFs.

 

You acknowledge and agree that the Company is not responsible for:

• Lack of PDF reader software

• Outdated devices or operating systems

• Browser incompatibility

• Storage limitations on your device

• Network interruptions

• Personal technology skill limitations

• Printer issues

• Inability to access third-party apps you independently choose to use with the product

 

The Company does not guarantee compatibility with every device, software version, or third-party platform.

 

CUSTOMER SUPPORT AND PRODUCT ACCESS ASSISTANCE

The Company may provide limited customer support related solely to basic delivery and access concerns. Such support may include confirmation that the product was sent, re-sending the link where appropriate, or confirming file format.

 

Support does not include:

• Personalized budgeting advice

• Individualized financial planning

• One-on-one coaching

• Ongoing tech support unrelated to delivery

• Device setup support

• Customized implementation guidance

• Training on how to use every third-party app, platform, or tool mentioned in the e-book

 

Any request for help with access issues should be made within 48 hours of purchase or within another reasonable period designated by the Company. While the Company may choose to assist outside that window, it is not required to do so.

 

EDUCATIONAL PURPOSE ONLY

All Fine Finances University digital products are intended strictly for educational, informational, and general guidance purposes only.

 

Nothing contained in the e-book or any accompanying product materials shall be interpreted as:

• Legal advice

• Tax advice

• Investment advice

• Accounting advice

• Financial advisory services

• Real estate advice specific to your transaction

• Personalized professional services

• A guarantee of financial improvement or success

 

The information is intended to provide general education and foundational guidance. It is not tailored to your unique circumstances, financial condition, debt profile, income, liabilities, risk tolerance, legal obligations, or future outcomes.

You remain solely responsible for seeking qualified licensed professionals for advice relating to your individual situation.

 

NO GUARANTEE OF RESULTS

The Company does not guarantee that you will achieve any particular personal, financial, educational, emotional, or business result from the purchase or use of any digital product.

 

No guarantee is made regarding:

• Savings outcomes

• Debt reduction

• Financial freedom

• Improved credit profile

• Increased income

• Better budgeting habits

• Investing results

• Decision-making outcomes

• Business performance

• Long-term financial security

 

Your results depend on many factors outside the Company's control, including your own discipline, consistency, circumstances, effort, judgment, outside obligations, and changes in the broader economy.

 

Any examples, illustrations, scenarios, strategies, or references in the e-book are provided for educational demonstration only and should not be construed as promises or guarantees.

 

CUSTOMER RESPONSIBILITY AND ASSUMPTION OF RISK

By purchasing and using any Fine Finances University digital product, you acknowledge that you are voluntarily assuming all risks associated with implementing, interpreting, or relying upon the educational information provided.

 

You accept full responsibility for:

• Your financial choices

• Your spending decisions

• Your budgeting decisions

• Your debt management decisions

• Your savings and investment decisions

• Your application of the concepts taught

• Your use or misuse of the content

 

The Company shall not be held responsible for outcomes resulting from the customer's interpretation, implementation, misuse, overreliance, or failure to seek individualized professional guidance where needed.

 

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Fine Finances University, Nya Gordon, and any affiliated owners, employees, contractors, agents, representatives, successors, assigns, and service providers shall not be liable for any losses, injuries, claims, liabilities, damages, or expenses arising out of or related to your purchase, access, download, use, misuse, inability to use, or reliance on the digital product.

 

This limitation includes, without limitation:

• Direct damages

• Indirect damages

• Incidental damages

• Consequential damages

• Special damages

• Punitive damages

• Loss of profits

• Loss of business opportunities

• Loss of data

• Emotional distress claims

• Financial losses

• Reputational harm claims

• Third-party claims related to your use of the product

 

In any event, the maximum liability of the Company, if liability is ever established, shall not exceed the amount actually paid by you for the specific digital product at issue.

 

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Fine Finances University, Nya Gordon, and all related parties from and against any and all claims, demands, actions, causes of action, liabilities, damages, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your breach of this Agreement

• Your misuse of the digital product

• Your infringement of the Company's intellectual property rights

• Your unauthorized sharing or redistribution

• Your violation of any law or third-party rights

• Your reliance on the product in a way not intended by the Company

 

This indemnification obligation survives termination of this Agreement.

 

CHARGEBACK, DISPUTE, AND FRAUD PREVENTION POLICY

By completing your purchase, you agree not to initiate a chargeback, payment dispute, reversal, or unauthorized transaction claim without first making a good-faith effort to contact the Company regarding the issue.

 

You understand that the Company maintains records that may include:

• Time and date of purchase

• Product selected

• Amount paid

• Billing information

• Download logs

• Email delivery confirmation

• IP address information

• Checkout acceptance records

• Platform transaction history

 

Where a customer initiates a chargeback or dispute in contradiction of this Agreement, the Company reserves the right to:

• Contest the dispute with full supporting evidence

• Suspend or permanently revoke product access

• Ban the customer from future purchases

• Report the incident to payment processors

• Pursue collection or legal remedies where appropriate

 

Fraudulent chargebacks, false non-delivery claims, unauthorized use of payment methods, or bad-faith disputes are taken seriously and may be escalated accordingly.

 

TERMINATION OR REVOCATION OF ACCESS

The Company reserves the right, in its sole discretion, to revoke, suspend, or terminate access to any digital product without refund where it reasonably believes that the customer has:

• Violated this Agreement

• Shared or distributed the product without authorization

• Used the content in a prohibited commercial manner

• Misrepresented identity or payment authorization

• Engaged in fraud, abuse, piracy, harassment, or misconduct

 

Termination of access does not waive the Company's right to pursue additional legal or equitable remedies.

 

THIRD-PARTY TOOLS, APPS, AND RESOURCES

Some digital products may reference or mention third-party tools, apps, websites, services, articles, or resources for educational context. Any such references are provided for general informational purposes only.

 

The Company does not control and is not responsible for:

• The performance, privacy, pricing, or functionality of third-party platforms

• Changes made by third-party companies

• Service interruptions, outages, or discontinued features

• Third-party data handling or terms of service

• Results obtained by using outside tools

 

Your use of any third-party platform is solely between you and that provider.

 

PRIVACY OF CUSTOMER INFORMATION

The Company may collect and retain purchase-related information reasonably necessary to complete the transaction, deliver the product, maintain business records, prevent fraud, and enforce its rights.

 

This may include:

• Name

• Email address

• Billing details as provided through a payment processor

• Product purchased

• Purchase date

• Delivery logs

• IP data where available through the platform

 

The Company does not sell ownership of its products through the transfer of your personal rights. Customer information is handled in accordance with applicable privacy practices and platform requirements, but the Company may use transaction records to defend against disputes, enforce its policies, and maintain operational records.

 

A separate Privacy Policy is recommended for your website so customers clearly understand how their information is collected, stored, and used.

 

TESTIMONIALS, FEEDBACK, AND CUSTOMER COMMUNICATION

If you voluntarily provide feedback, comments, reviews, testimonials, suggestions, or other communications regarding a product, you grant the Company the right to use that feedback for business and promotional purposes, provided the use complies with applicable law and the Company's stated practices.

 

The Company is not obligated to keep submitted ideas, improvement suggestions, or non-confidential feedback private unless expressly agreed in writing.

 

The Company also reserves the right to communicate with customers regarding:

• Product delivery

• Access issues

• Updates to the purchased file

• Policy enforcement matters

• Transaction verification

• Fraud prevention issues

 

PRODUCT UPDATES, REVISIONS, AND FUTURE CHANGES

Unless expressly stated otherwise at the point of sale, a purchase of a digital product entitles the customer only to the specific version delivered at the time of purchase.

The Company may revise, improve, expand, retire, rename, or discontinue products at any time. The Company is not obligated to provide future updates, revised editions, bonus materials, replacement products, or later versions unless such access was explicitly included in the original offer.

The Company may, at its discretion, provide updated versions or corrected files, but is under no obligation to do so.

 

FORCE MAJEURE

The Company shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond its reasonable control, including but not limited to:

• Internet outages

• Platform failures

• Payment processor disruptions

• Cybersecurity incidents

• Acts of God

• Natural disasters

• Government actions

• Labor shortages

• System failures

• Email service interruptions

 

In such cases, the Company will make reasonable efforts to restore product access or delivery when feasible.

 

NO WAIVER

Failure by the Company to enforce any provision of this Agreement shall not constitute a waiver of the Company's right to later enforce that provision or any other provision.

Any waiver must be in writing and signed by an authorized representative of the Company.

 

SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Any unenforceable provision shall be interpreted as closely as possible to reflect the original intent while remaining legally enforceable.

 

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by, interpreted, and enforced in accordance with the laws of the State of Alabama, without regard to conflicts of law principles.

Any dispute, claim, or controversy arising out of or related to this Agreement, the purchase, the digital product, or the relationship between the parties shall be brought exclusively in the appropriate state or federal courts located in Alabama, and you consent to the personal jurisdiction and venue of those courts.

 

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties with respect to the purchase and use of the digital product and supersedes all prior or contemporaneous discussions, representations, understandings, communications, or agreements relating to that subject matter.

No oral statement, informal communication, social media message, or customer assumption shall modify or override the terms of this Agreement unless expressly stated in writing by the Company.

 

ACCEPTANCE OF TERMS

By clicking purchase, completing checkout, downloading the file, opening the digital product, or otherwise using the product, you confirm that you:

• Have read this Agreement

• Understand this Agreement

• Agree to be bound by this Agreement

• Understand that all sales are final

• Understand that the product is digital and non-refundable

• Understand that your use is limited to personal, non-commercial use only

• Understand that unauthorized sharing, copying, and resale are prohibited
